Terms & Conditions

  1. Breakwater Holidays act only as Agents for the owners of the accommodation and the Contract of Letting is between the Guest and the Owner.
  2. Breakwater Holidays accepts no responsibility for personal injury to Guests, or loss of or damage to their property, or for other matters over which Breakwater Holidays has no control.
  3. No bookings are valid or confirmed until a deposit equivalent to thirty percent of the cost of the holiday has been taken. Payment of the balance of the cost of the holiday will be taken eight weeks befopre arrival.
  4. The agreement is made on the basis that the property is to be occupied by the Tenant for a holiday as mentioned in the Housing Act 1988 Schedule I Para 9 and the Tenant acknowledges that the tenancy granted by this agreement is not an assured tenancy and that no statutory periodic tenancy will arise when it ends.
  5. Bookings cannot be taken from persons under 18 years of age.
  6. Once a booking has been confirmed by Breakwater Holidays, the Guest is responsible for the balance of the cost of the holiday. Breakwater Holidays reserve the right to relet any holiday where the balance outstanding is more than 7 days in arrears. However, if we are unable to relet the holiday, the Guest remains liable for the outstanding balance.
  7. In the event that accommodation becomes unavailable, Breakwater Holidays will endeavour to provide suitable alternative accommodation or will refund all monies paid or a proportion in the event of curtailment.
  8. Some of our properties will allow pets but this is only with prior agreement at the time of booking. Any Guest found with pets in any properties without prior agreement will be asked to leave.
  9. The Guest shall keep the holiday accommodation and all furniture, fixtures, fittings and effects in or on the holiday accommodation in the same state of repair as at the commencement of the holiday and shall leave the holiday accommodation in the same state of cleanliness and general order in which it was found. The Guest must report and pay to the owner the cost of any damage or breakages made during their holiday occupancy.
  10. The Guests right to occupy the property may be forfeited without compensation if the number of people occupying the property exceeds the full occupancy, if pets are brought into the property or if any activity is undertaken which may cause unreasonable, damage, noise or disturbance.
  11. All prices quoted include VAT where applicable at current rates.
    In the event of there being any complaint concerning a property, the matter should be taken up with Breakwater Holidays at once; in no circumstances will compensation be made for complaints raised after the tenancy has ended.
  12. Bed linen and towels are supplied and all utilities (water, gas and electricity) are included within the price of the holiday.
  13. In order to ensure that we can maintain our high standards of presentation and cleanliness, Guests are requested to arrive after 3pm and depart before 9.30am.
  14. In the event that a Guest has to cancel a holiday, Breakwater Holidays requires that all cancellations are notified by telephone and then put in writing to us at Breakwater Holidays, 95 Kings Hill, Bude, Cornwall, EX23 8QL.
  15. The Booking Conditions will apply to all bookings.
